Terms & Conditions

These terms and conditions apply to the purchase of any goods/ products from Bed Butler Limited. By accessing our website and or/ placing an order you agree to be bound by all of the terms, conditions and policies set out below or within the website. Nothing in these conditions affects your rights as a consumer.

Payment for Goods:

  • We will treat each order for goods as an offer by you to purchase the goods subject to these Conditions. You are deemed to accept the Conditions when you place an order for goods with us. Our contract with you only begins when we confirm acceptance of your offer to purchase goods from us. An order will not take place (and we will not be deemed to have accepted your order) until we have validated and confirmed your payment. Any communication, which you receive from us prior to validation, is not to be deemed as an acceptance of your order. In the event of any pricing error occurring within our website, within a written or verbal quotation, or contained within any fax or e-mail correspondence however received, all incomplete orders shall be deemed void.
  • Many of the goods we sell are of a technical nature and whilst we endeavour to publish as much information as is practical about the goods, the descriptions of the goods are as set out on the website. All drawings, photographs, descriptive matter, colour, specifications and advertising on our website are for the sole purpose of giving an approximate idea of the goods. They will not form part of the contract between us.
  • Your order for goods is subject to stock availability. If we do not supply goods to you for any reason we will inform you of the situation and will not charge you for those goods, and will refund any money already paid by you for these goods. We are not liable for any financial loss incurred by you relating to interest payments, or loss of earnings, or similar gains you would have received on monies paid to us in lieu of any unfulfilled order.
  • Payment for goods must be made in accordance with our purchase procedure as set out on our website. All orders are positively credit card sanctioned prior to dispatch. We can accept no responsibility if any details you provide us with that are incorrect or if any order is held up as a result of incorrect or unsubstantiated details.

Guarantee:

  • All new goods are sold with the benefit of a minimum 12-month manufacturers guarantee. Full warranty details are available with your product, or from our customer services team. It is your responsibility to complete and return the purchase registration form enclosed with the goods to the manufacturer.
  • If these goods are deemed tampered with in any way your warranty will become void and you will become responsible for the costs of replacement and return shipping. If no manufacturing fault is found you will be responsible for the costs of replacement and return shipping. Wherever possible we will respond to your individual circumstances. Will not be liable for any transit damage that may occur on any product you have returned to us for replacement. We strongly suggest that you make sure you have used sufficient packaging to protect your product and insure against damage before returning any product for replacement. For advice on how to pack your goods safely before return please contact our customer service team.
  • The warranty does not cover accidental damage, modifications to, failure(s) not due to manufacturing defect(s), when any warranty void sticker has been tampered with, failure to comply with the original manufacturers conditions of intended use, any accessories supplied. Coolflex.co.uk cannot be held responsible for any costs arising from unauthorised repairs to equipment during the warranty period. Only Coolflex.co.uk or the equipment manufacturer or their authorised service agents can carry out any warranty work. Any unauthorised repairs or repair attempts will void the warranty.
  • In relation to new goods the company will accept liability for defective goods only to the extent that the company is entitled to make a claim under the manufacturer's or publishers warranty and obtain from the manufacturer or publisher a refund, credit, repair or replacement of the defective goods.

Delivery Of Goods

  • Delivery of the goods shall be made to UK mainland addresses only and must be signed for. The address will be that registered with your payment card issuer, unless you request otherwise and we agree to such a request (at our sole discretion).
  • We will endeavour to deliver your goods if in stock within 3 - 5 working days (with the exception of weekends & public holidays) but time shall not be of the essence. If we are unable to deliver the goods for any reason you will be notified and will not be obliged to pay for the goods. However, we shall not be liable for any loss, which may be suffered by you caused by any delay of delivery unless caused by our negligence. If delivery of the goods is delayed by more than 30 days, you shall be entitled to contact us and cancel the order. Any monies paid in respect of the goods, which are not delivered, will be refunded.
  • Goods, other than faulty goods may not be returned after 7 days unless we agree that there is good reason for us to receive such goods back. If we agree to accept these goods back into stock they are subject to a £69 delivery cost fee. Incorrectly ordered goods or non-delivery (customer out) items are also subject to a £69 delivery cost fee. We regret that we cannot accept returns of the following: Divan bases, pillows, mattresses and products that have been made to a bespoke size or personalised. The above products will be exempt from the statutory 7 day cooling off period where the products have been unsealed, and your right to cancel will have ended for reasons of health and hygiene as the product will be deemed to have been used. We recommend that you make full use of our sales team for advice prior to purchase. We adhere to the Customer Protection (Distance Selling) Regulations 2000 No. 2334.
  • If goods arrive in a damaged condition you must inform us as soon as possible. We shall arrange collection of the goods (other than used goods) and will either replace the goods at no extra charge, or refund any monies paid by you for the goods.
  • We will deliver to business addresses at your request but stress that if instructed to do so, the card used in the transaction must be officially registered to that address. Also you are agreeing that anyone situated at your business address has your written authority to accept goods on your behalf. We will accept no responsibility for goods once they have been delivered to and signed for at the requested address.

Credit & Exchanges

  • We will provide a full refund (excluding delivery charges) if the product you have selected is found to be unsuitable within 7 working days following delivery, providing the product is returned in it's original box, in 'as new' condition, unmarked and all polyurethane packaging unsealed.
  • Vacuum Packed Mattresses. This particular product will be exempt from the statutory 7 day cooling off period where the products have been unsealed, and your right to cancel will have ended for reasons of health and hygiene as the product will be deemed to have been used. We recommend that you make full use of our sales team for advice prior to purchase. We adhere to the Consumer Protection (Distance Selling) Regulations 2000 No. 2334.
  • All returns carriage costs will be borne by you the sender.

60 Night Comfort Guarantee

  • This 60-night trial agreement is entered into by The Bed Butler Limited (referred to as "we", "us", "our" or "The Bed Butler") and you, the Customer (referred to as "you" or "your") placing the order to receive our products (the "Products", as defined on our website) on a 60-night trial basis. By taking our Products on the 60-night "no commitment" trial basis, you accept these terms and conditions.
  • The Products are supplied to you on the TERMS AND CONDITIONS WEBSITE and the TERMS AND CONDITIONS ONLINE SALES as set out on the website. The terms of this 60-night trial are in addition to those terms. The 60-night trial is only available for our standard size mattresses. Please note the trial is not available for any product which has been customised by us in any way or has been made to meet your particular requirements. This does not affect your statutory rights.
  • Only one mattress can be trialled per household. If you order more products than stated above, our Direct Sales Team will be in contact with you to discuss your order. The 60-night trial will commence from the date on which the Products are delivered to you and will end at midnight on the 60th day after that date.
  • The 60-night trial is only available to residents at addresses within mainland UK, excluding Northern Ireland and all offshore islands
  • Please ensure that the Products are in satisfactory condition when you receive them. If the Products are soiled or damaged on delivery to you, you must tell us as soon as possible and in any event within 3 days of delivery, so that we can arrange for collection and (if requested) exchange of any Products.
  • We ask that you trial the Bed Butler Mattress for the full 60 nights. This will allow time for a true evaluation of the benefits. There can sometimes be an adjustment period when you begin to sleep on the mattress. Some people have experienced a feeling of stiffness after the first couple of nights. This is normal as the mattress is realigning your body to its natural sleeping position. That is why we recommend that you try your Bed Butler Mattress for full 60 nights
  • The driver is required to risk asses the requested relocation of the customers' own bed base/mattress. However this request could be refused on the grounds of health and safety.
  • Any relocation of a customers' own bed base/mattress within a customers property is at the sole discretion of the driver and is at the customers own risk.
  • It is the customer responsibility to make sure that all breakable and hazardous items have been removed and there is sufficient access to the requested location.
  • All returns carriage costs will be borne by you the sender. Bed Butler can offer a collection of goods for a fee of £69. The consumer however is not obliged to use this service, and can arrange their own return of goods.
